What’s Changing with Hemp Laws in Texas (March 2026 Update)

There’s been a lot of information going around and honestly, a lot of confusion too.

So we wanted to take a moment to break things down in a clear and simple way, and explain what this means for you as a customer.


New Rules from the State of Texas

As of January 2026, new rules have been finalized around consumable hemp products.

Here’s what you need to know:

1. Age Requirement (21+)

Hemp products can now only be sold to individuals 21 years and older.

This aligns more closely with alcohol regulations.

2. ID Verification

All purchases now require valid government-issued ID verification, every time.

3. Updated Enforcement Rules

The state has adjusted how violations are handled:

  • First offenses may result in a temporary suspension

  • Repeated violations could lead to license revocation

These updates bring more structure to the industry while still allowing businesses to operate responsibly.

Upcoming Change: Smokable Hemp Products

There is another major change expected to take effect:

➡️ Starting March 31, 2026, smokable hemp products (such as flower and pre-rolls) are expected to be removed from the Texas market.

This change comes from updates tied to the Department of State Health Services (DSHS).

What Products Will Still Be Available?

Even with these changes, many products will still remain available, including:

  • Gummies

  • Edibles

  • Beverages

  • Other non-smokable hemp products

These fall under different regulatory categories and remain legal under current Texas law.
