Texas Hemp Industry Update: What’s Happening Right Now

Recap:Recent enforcement in Texas has changed how THC is calculated, now including THCa as total THC, which has led to the removal of certain hemp flower products from shelves starting March 31st. These changes, along with proposed licensing fee increases from $150–$250 to around $5,000 per location, are creating significant challenges for hemp businesses across the state.

The Industry Response

In response to these changes, leaders within the Texas hemp industry are coming together to take action.

Companies like Hometown Hero, along with the Texas Hemp Business Council, are working with legal teams to file a lawsuit against the state.

This lawsuit is expected to be filed on Tuesday, April 7th, 2026, with the goal of seeking an injunction that could temporarily pause enforcement of these new rules.

Legal teams have been gathering evidence from multiple businesses across Texas to demonstrate how these changes are impacting the industry, employees, and customers.
